1. Introduction and Acceptance of Terms

Welcome to Loanedz.

These Terms and Conditions ("Terms", "T&C", or "Agreement") govern your access to and use of loanedz.com, including all associated services, tools, and features (collectively referred to as the Platform).

This Agreement is an electronic record under the Information Technology Act, 2000, and does not require a physical or digital signature.

By accessing, browsing, or using the Platform, you agree to be legally bound by these Terms and all incorporated policies, including the Privacy Policy and Grievance Redressal Policy.

If you do not agree with any part of these Terms, you must immediately discontinue using the Platform.

These Terms, together with the Privacy Policy, constitute the complete agreement between you and Loanedz regarding the use of the Platform.

2. About Loanedz

Loanedz operates as a digital loan marketplace and financial information platform.

We connect prospective borrowers with:

  • Registered Banks
  • Non-Banking Financial Companies (NBFCs)
  • RBI-regulated Lending Partners

Loanedz:

  • Is not a bank or NBFC
  • Does not lend money
  • Does not sanction loans
  • Does not determine loan eligibility

Loanedz acts solely as a technology facilitator.

Any loan approved or disbursed is a contract exclusively between you and the relevant Lending Partner and is governed by their terms and RBI regulations.

3. Eligibility

To use Loanedz, you must:

  • Be an Indian citizen or an NRI with a valid Indian bank account.
  • Be at least 18 years of age.
  • Have legal capacity to enter into contracts.
  • Not be declared insolvent or bankrupt.
  • Provide accurate, complete, and up-to-date information.

Loanedz reserves the right to terminate access if eligibility information is found to be false or misleading.

4. Services Offered

4.1 Loan Marketplace

Loanedz enables users to:

  • Compare loan products
  • Check indicative eligibility
  • Apply for:
    • Personal Loans
    • Home Loans
    • Business Loans
    • Education Loans
    • Vehicle Loans
    • Debt Consolidation Loans

All eligibility results are indicative and non-binding.

4.2 Financial Tools

Loanedz provides free financial calculators including:

  • EMI Calculator
  • Loan Eligibility Checker
  • Loan Comparison Tool

Results are for informational purposes only and do not constitute financial advice or a loan offer.

4.3 Information Services

Loanedz publishes:

  • Educational articles
  • Loan guides
  • Product information

The content is intended solely to help users make informed financial decisions and should not be considered professional financial advice.

5. User Obligations

By using the Platform, you agree to:

  • Provide accurate and truthful information.
  • Use the Platform only for lawful purposes.
  • Not attempt unauthorized access.
  • Not upload malware or malicious software.
  • Not impersonate any individual or organization.
  • Not use bots, crawlers, or scrapers without written permission.
  • Comply with all applicable Indian laws.
  • Report any unauthorized account activity to privacy@loanedz.com.

6. Data Consent and Collection

By submitting information through the Platform, you consent to Loanedz:

  • Collecting and processing your personal information.
  • Sharing your data with Lending Partners.
  • Processing sensitive information including PAN, Aadhaar (where applicable), and credit score.
  • Contacting you via:
    • Phone
    • SMS
    • WhatsApp
    • Email

This consent applies even if your number is registered under DND/NCPR.

Data processing complies with:

  • IT Rules, 2011
  • DPDP Act, 2023

7. Loan Applications and Third-Party Lenders

When applying through Loanedz:

  • Your application is shared with selected Lending Partners.
  • Loan approval is solely at the lender's discretion.
  • Interest rates, tenure, EMI, and fees are determined by the lender.
  • Loanedz does not guarantee loan approval.
  • Loanedz does not charge borrowers for using the Platform.

Users should carefully review the lender's:

  • Terms & Conditions
  • Fair Practices Code
  • Key Facts Statement (KFS)

before accepting any loan.

8. Intellectual Property

All Platform content, including:

  • Logos
  • Text
  • Graphics
  • Software
  • User Interface
  • Databases

is the intellectual property of Loanedz or its licensors and is protected under Indian intellectual property laws.

Content may only be used for personal, non-commercial purposes.

Unauthorized reproduction or distribution is prohibited.

9. Disclaimers

Loanedz:

  • Is only a marketplace and information platform.
  • Does not provide financial advice.
  • Does not guarantee loan approval.
  • Does not guarantee the accuracy of lender information.

The Platform is provided "As Is" and "As Available" without warranties of any kind.

10. Limitation of Liability

Loanedz shall not be liable for:

  • Reliance on Platform information.
  • Loan approval or rejection decisions.
  • Indirect or consequential damages.
  • Unauthorized access beyond reasonable control.
  • Technical failures or downtime.

Maximum aggregate liability is limited to:

INR 10,000 (Indian Rupees Ten Thousand Only).

11. Indemnification

You agree to indemnify Loanedz against any claims arising from:

  • Your use of the Platform.
  • Violation of these Terms.
  • False or misleading information.
  • Disputes with Lending Partners.

12. Modifications

Loanedz may update these Terms at any time.

Changes become effective immediately upon publication.

Continued use of the Platform constitutes acceptance of revised Terms.

13. Termination

Loanedz may suspend or terminate access without notice if you:

  • Violate these Terms.
  • Commit fraud.
  • Provide false information.
  • Misuse the Platform.

Upon termination, all granted rights immediately cease.

14. Third-Party Websites

The Platform may contain links to third-party websites.

Loanedz:

  • Does not endorse these websites.
  • Is not responsible for their content.
  • Is not responsible for their privacy practices.

Accessing third-party websites is entirely at your own risk.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of India.

Dispute resolution process:

  1. Mutual negotiation for 30 days.
  2. Binding arbitration under the Arbitration and Conciliation Act, 1996.
  3. Sole Arbitrator appointed by mutual agreement.
  4. Seat of Arbitration: New Delhi
  5. Language: English

Courts located in New Delhi, India, shall have exclusive jurisdiction over matters not subject to arbitration.
